A DISPUTED AGREEMENT.
THE SALE OE A FARM. COURT RESERVES DECISION. At the sitting of the Supreme Court, New Plymouth, on Saturday, His Honor Sir John Salmond continued the hearing of the claim by Jessie A. Bartlett (of Hawera), against T. F. and J. H. Graham, for £IOO damages for nonperformance of agreement to purchase plaintiff's property; also €SOOO if agreement could not lie performed. Mr. Hutchen appeared for claimant.
A counter claim was made for the recission of the agreement, refund of £2OO deposit, and, £ISOO damages if the Court 'held the agreement should be .performed. Mr. F. 0. Spratt (Hawera) represented defendants. Evidence called in support of the claim was given by J. R. Corrigan, Hawera, Francis Gillanders, Hawera, Lewis Eustace, Hawera, Henry A. and Carlyle Bartlett (sons of plaintiff), and Alfred Willcox (brother-in-law of plaintiff). At the conclusion of the evidence, His Honor announced that he would reserve his decision.
