At the Supreme Court to-day, a decision was reached on the claim for £2OOO damages for .alleged libel preferred by Robert Charles Diek, ranger and assistant road inspector for the Hutt County Council, against 14 defendants. ■ Plaintiff alleged that with the object of securing his dismissal from bis employment the defendants petitioned the Council to the effect that during the recent (the general) election, during hours upon which he was supposed to be engaged in the Council's work, he was actively employed in canvassing for the '■Red Fed" and disloyal organiaations' candidate-! for the, Otaki and Hutt electorates. TV defence was that the petition was privileged, that it was sent in the publie interest, and without malice. Further, that plaintiff liad not lost his position in consequence, thereof. The jury found that all the. defendants wore actuated by an express malice towards the plaintiff in publishing the words complained of, and awarded £2OO damages. The defendants' counsel was given an extension of time in which to move a non-suit point, and any other motion necessary.
