August 13, Mr. T. A..8, Bailey, S.M., presided at the sitting of the Court to-day. A sequel to an accident on Broadway North wag. provided to-day try the prosecution of J. W. Davidson for driving a motor car on sth August in a manner dangerous to the public. " The defendant, who waa represented by Mr. L. M. Moss, pleaded guilty, but it was suggested for the defence that the gig driver (Hiekey) waa partly at fault in suddenly pulling out from tha stream of traffic, without giving the usual signal. The Magistrate; in view of the fact that defendant had already suffered pecuniary loss imposed the nominal fine of 10 s without costs. For driving a motor car along the line at Kohuratahi, C. K. McCutcheon, who pleaded guilty, was fined 20s and costs Judgment for plaintiff by default was entered in the following%ases:—P.A.C. v. Myra L. Simmons £3 5s fid, costs 17s; W. Forman v. T. A. Lonergan 14s, fcosts ss. A charging order was made against the moneys held by the secretary of the N.Z. Racing Conference on behalf of Fred Cook, apprentice jockey, for the sum of £l2, being the maintenance due for the support of Cook's brothers in industrial school. ■ MOTOR CAR REPAIRS. ,A claim totalling £6O 17s 6d, for motor car repairs effected, was preferred by ,F- V. Burkett (Mr. R. R. Tyrer) against Mrs. P. Stachurski (Mr. C. H. Croker). Defendant filed a counterclaim of £IOB, for hire of a motor car or taxi oar. For plaintiff, several witnesses giving evidence that the motor car was in a shocking condition when its repair was undertaken by plaintiff, and that it was in perfect working order when returned to defendant. Also, it was stated by plaintiff, and endorsed by his witnesses, that the motor car in question was not used for hire work except on one occasion. Mr. Croker produced in Court the differential gears of the car, showing the shider broken and with only two spindleß sounij, ' He asked plaintiff to' state whether, in view of the fact that the broken part had been taken from the car before it had been run a hundred miles after repair, ho could truthfully say that the car was halided back in perfect running order. His Worship remarked that he could not understand it, as, from the evidence given, the car was in good running order when handed back. On the completion of the case for plaintiff, the Court adjourned until next sitting. ■ ■ - \ Ernest Norman Heal (Mr. Truby King) sought to recover from C. Lamplough (Mr. A. Coleman), the sum of £l7 10s. GENERAL. Mr. R. Masters, M.P., ia expected in Stratford from Wellington on Saturday night in readiness to attend the Education Board meeting on Monday.
