EVIDENCE AT A BE-TRIAL By Telegraph.—Press AjsooltUon. f . Auckland, Latt Night. The re-trial of Alfred Thomas «rcj Dare, on a charge of having committeJ manslaughter by killing Mr. A. J, Hor ton.at Penrose, on January 80, wai commenced at the Supreme Court fo. day. It was alleged that the accused ww the driver of a motor-car which collided with a bicycle ridden by Horton, whi sustained fatal injuries, , The evldenc* was in the main the game as that given' in the previous trial. Dr. Beattie stated that he taw ,the accused, at the request of the Crown Prosecutor, on June 14, to examine him in regard to alleged shell shock. Counsel for the accused here injected to tho evidence of Dr. Seattle being'admitted. Th G Judge said he would admit evidence as to the result of the doctor's examination. Witness then said he came ia the oon« elusion that the accused wa» normal, both mentally and physically. His Honor said he thought this was as far as witness should go. The case was not unished when the Court adjourned.
