CLAIM FOR POSSESSION. C. S. Curtis (Mr. R. R. Tyrer) claimed possession of a tenement from C. L. Grant (Mr. A Coleman) Mr. Tyrer said that the plaintiff had sold the house principally on account of the defendant having got into arrears with his rent. He did not wish to cause defendant any hardship. Mr. Coleman Raid the rent had been paid in full before the summons was issued. The Magistrate said that in dealing with such cases he could not give possession where the rent had been paid up, unless the owner actually required the house for his own use, or sold it to someone else who wanted it for his own use. The position was different from what it was a few years ago. Then, if notice to quit was given and the rent was in arrears, the owner could turn the tenant out. Now, if notice to quit was given and the rent was paid after the summons for possession was issued, the tenant could only be turned out if the owner required to live in the house himself. Mr. Coleman remarked that the defendant had a wife and seven children, and the new purchaser and his wife were living with a relative in a nine-roomed house. Judgment was given for the defendant, with costs. LEGION OP FRONTIERSMEN.
