Ohristchurch, Last Night. ■ Reserved judgment was delivered today by Mr. Justice Hertaran in the case in which Albert Badford, inspector of Banks Peninsula Rabbit Board ap. pealed against the decision of the Mag. istrate, Mr. V. G. Day, dismissing an information against Richard Candy, sheep farmer, i/ho was charged with having failed to take reasonable steps to des< troy rabbits on his land. Mr. Justice Herdman said the Magi* trate dismissed the information on th« ground that he was not satisfied Appellant had taken sufficient means to satisfy himself reasonably that the requirements of the Act had not been *ul< filled. His Honor held that, under the Rabbit Nuisance Act, 1882, the Lutpeci ' tor's opinion was decisive when the ques< tion for determination was whether the acts done by an owner were suclras were necessary for the destruction of rabbits. The Rabbit Nuisance Act, 1918, made it clear that the Magistrate should have acted on the opinion of the Inspector, The appeal was allowed with costs, and the case was remitted back to the Magistrate for further action.
