SOME PECULIAR FEATURES. A tenancy case. in which there were some peculiar features came before the Magistrate (Mr T. A. B. Bailey) at New Plymouth yesterday. C. W. Nixon (Mr T. P. Anderson) claimed ;£(i »/- from A. B. Gibson (Mr H. B. Gibson) for five weeks' rent of a dwelling at 25/- per week. Mr Gibson offered to accept judgment for an amount equal to rent for the period at 22/6 per week (the original rate), but this was not accepted 1 . It was stated by 31r Anderson that up to July 14 last defendant rented the house for 22/6 per weak on a monthly tenancy basis. At that date an agreement was entered into whereby defendant was allowed to remain in the house until the end of the year at a rental of 25/- per week. A copy of this"agreement was put in. This increased rent was paid up to October Ist, and the claim was for the five weeks up to November sth, at which date defendant quitted the house.

Mr. Anderson submitted that the new agreement was for the rental of the house at a fixed rent for a definite term. Defendant submitted that under tic? War Legislation Act the increased rent was not recoverable, notwithstanding the agreement. Some argument took place over the purpose and meaning of the Act, after which his Worship gave judgment for the amount offered by Mr. Gibson (£5 12s fid) and costs.
