a TRADE-MARIv CASE. % Telegraph.—Presa Association. Wellington, Nov. 13. _ At tlie Supreme Court, Daniel Moir is being charged with the falsification of a trade mark with intent to deceive and defraud the original owners. Ac* tion is being taken on the information of Arthur C. Nottingham, New Zealand attorney for .Tcves' Sanitary Company, and the indictment is that accused did falsely apply to goods a certain mark, so nearly resembling the registered trade-mark of Jeyes' Sanitary Compound Company, of 64 Cannon Street, London, manufacturing chemists, as to be calculated to deceive with intent, and thereby to defraud the said company. Mr. Macassey was for the Crown and Mr J Findlav and Mr. L. Edwards warf for the accused, who pleaded not ffuflty. 1 The evidence for the prosecution, was; similar to thnt in thf lower court. ' Sir J. Findlay said that the whoW question was one of honesty, and thß defence was no technical infringement tot the trade-mark but that the label* had come into the hands of defendant from his predecessors and that the de« fendant was entirely ignorant of anv infringement, and that he had acted vrith an honest mind. After further evidence the case Wa» adjourned till to-morrow.
