APPEAL COURT.
MARCONI WIRELESS CASE. By Telegraph.—Press Association. Wellington, October 14. The Appeal Court is hearing the case, re Marconi Wireless _ Telegraph Company, an application by the SolicitorGeneral, representing the Crown, and the Registrar of Patents for leave to appeal against the judgment of Sir Robert Stout, Chief Justice, whereby a patent of the company was extended for a period of seven years. His Honor dismissed the motion to rescind the order, and against this decision the Crown and Registrar of Patents now wish to appeal. The Solicitor-General submitted that the judgment was wrong in that the Chief Justice had only taken into consideration the remuneration obtained by the company in New Zealand, whereas he should have considered whether the company had been adequately remunerated all over the world. An application for an extension had been recently refused in England. The patent is concerned with what is known as the Fleming valve. Mr M. Myers appears for the company. Wellington, Last Night. The Appeal Court granted the Crown's application for leave to appeal in the Marconi case, holding that the Registrar of Patents was entitled to be heard and should have been notified of the time of the hearing of the petition. The Court could only extend the patent if the invention had been insufficiently rewarded The Chief Justice.clearly proceeded on the basis of profits in New Zealand only. The patent had been refused in England, and the Crown and the Registrar of Patents should have to opportunity to have the matter fully discussed. In considering the question of delay in giving notice of appeal it was impossible to separate the matter from the above coniderations. The Registrar should therefore have leave to appeal.
