Michael: McCairn, alias William Langley, a prisoner being eonveyed from Auckland to Fending under police escort, escaped from , the train near Raurimti. A prisoner named Jamea Claude Irwin escaped from Waikeria prison camp last night He stole a haek from the farm dairy. A man answering Ms description was seen going in the direction of K&whia. AN INTERESTING' EEOAL POINT. Hamilton, June 13. In tho Supreme Court Victor Rupert Anderson, on charges of escaping from legal custody while under remand for theft, disappeared from the Waikato hospital, where he was undergoing treatment. Counsel moved to quash the indicttnent, claiming that accused was not in lawful custody at the time of his escape.
His Honor said that it was the first time the question had arisen in New Zealand. The jury returned a verdict of guilty on the facts, but the point whether he was in legal custody and if it was a criminal offence was reserved for the-Court of Appeal
