AN INTERESTING JUDGMENT.

KACECOUKSBS AND PROHIBITED PEKSONS. By Telegraph.—Press Association, Hastings, May 14. Mr Dyer, S.M., delivered his reserved judgment in the ease Police v. Hollis, who was charged under section 215 of the Licensing Act with being a prohibited person, having entered licensed premises, viz., the licensed .booth on the racecourse. The defence was that the booth was not within the meaning of licensed premises in section 215. The conditional license was issued under section 82, and no mention was made of any particular premises, which is the case in dealing with publicans' licenses. The Magistrate, in his judgment, held that a place where liquor is sold under a conditional license was only to he considered licensed premises in so far as offences against public order, illicit sales and adulteration of liquor were concern«sd. In respect to prohibition orders, he did not think the places to which the conditional license referred could be deemed licensed premises. He thought •therefore the defendant did not enter licensed premises. The information was, therefore, dismissed. In view of the Magistrate's decision a. member of the Hawlce's Bay Licensing Comniittee has filed a notice o£ motion that the committee refuse any more StKmcKtional licenses if the judgment is upheld.
