A remarkable High Court judgment affecting Mr Justice Higgins' award was given in the ease brought by the Waterside Workers' Federation against a Sydney firm for alleged breach of award. In this the Court found that the constitution of the Court of Conciliation and Arbitration was not beyond the powers of Parliament regarding its arbitral provisions, but was as regard enforcing the provisions.
