LESSEES OF BUSINESS PREMISES.
CALLED IN BALLOT. A case of considerable interest at this juncture came before the Magistrate's Court at Hawera 011 Tuesday, when Holmes and Arthur, storekeepers, of Opunake, brought an action against Mr, Jeffries, the owner of premises' leased to them, for determination of the lease by ■reason of their being called up for military service. Mr. E. Holmes appeared for-Holmes and Arthur,.and Mr, : B McCarthy for Jewries. Mr. Marshall stated that plaintiffs leased premises in Opunake as a general store. They were recently called up in the ballot, Holmes being medically classes CI, and Arthur Al. Both would have to go into camp shortly. Mr. McCarthy said he was acting as attorney for Jeffries, who was now in hospital at Wellington. The lessees had given up business to go into camp, and the store was now unoccupied. Bent had been paid except for the last two months. The lease had been granted some time prior to the , fixe, ami until the new building had been erected they had paid half rent. He considered that more notice should have been given of the surrender of the lease. His Worship said this was the first case of the kind in the district. He suggested that under the circumstances it would be equitable to terminate the lease as from June 30, with adjustment of rates and insurance. This was agreed to by the parties concerned. His Worship therefore adjourned the case for a week, with an intimation that if an agreement were made to surrender the lease as from June 30, with, adjustment of rates and insurance, and an agreed sum for painting the premise!, the lease will be ordered to be cancelled.
