At the Magistrate's Court, New Plymouth, 'yesterday, bef/.rs Mr. A. Crooke, •5.M.,-judgment was given for plaintiffs 'by default in the following undefended ca?es:—Sargood Son and Ewing, Ltd. (Mr. H. E. Billing), v. G. G. N. Nightingale, £28.15s (id (costs £2 14a); Cook and Lister (Mr. A. C. Lawrie) v. Alhol fairs fl 2r (costs ss); Myrtle Allen (Mr -P. B. FiUherbert) v. George Cleaver, £ll (costs £1 Os Gd).
| JUDGMENT SUMMONSES.' Orders were made as stated in the following judgment summonses eases:— Stephen Hale (Mr. A. Bewley) jv. John Lowrie. Judgment debtor to pay €7 lis (id on or before March 2(i, in default eight days' imprisonment. Joseph Jenkinson (Mr. Billing) v. F. W, Washbourne. Debtor to pay the sum of £ll lis on. or before March 2fi. in default 12 days' imprisonment. N.Z. Express Co. (Mr. A. A. Bennett) v N. G. G. Winkelmann (Mr. R. C, Hughes). Debtor to pay the sum of £4 5s 4d forthwith, in default five days' imprisonment, the order to by suspended so long as he pai<][ the sum of 10s per week, the first payment to be made within 1* da vs.,
A. E. Magon (Mr. Bennett) v. N. G. G Winkelmann. Debtor was ordered to •piv the sum of £8 (is Cd under the same terms as in the previous case.
MAORI CATTLE CLAIM. The Magistrate delivered judgment in the:.case of Atiria Te Kahakohu (Mrs. Te Whiti) v. Ngatai Perereha, a claim in lcpect to seventeen- head of cattle which it was alleged defendant had failed to .i"ro\int for. His Worship reviewed the evidence given at the trial, which was somewhat lengthy, and gave judgment for the plaintiff- He said he had some difficulty in determining the amount. TVre'was no doubt as to the value of four cattle which had been sold, but no evidence was given as to'-the. value of th» other thirteen cattle. There was nothing to show how many of those were st»ers and how many were heifers. The other heifers had 'been sold, at £4 e< ch and £5 was claimed for the steers. Fis Worship suggested the parties should agree as to the value of the thirteen beasts unaccounted for.
Mr. Fitzherbcrt, who appeared for p'.-i:iitiff, intimated he woulrFaeeent £4 a* the average value of the cattle. -, Mr. Johnstone (for defendant) Raid he Wss not to be understood as agreeing t> that.
Judgment was entered for £l2 for the three heifers, £5 for the heifer, and £?2 for the balance of the cattle. Costs and witnesses' expenses amounted to £l3 Bs.
BREACHES OF BY-LAWS. Several cases of breaches of the bylaws of the Borough of New Plymouth, adjourned from last Thursday were dealt with. The borough inspector (Mr. R. Day) stated that prior to the race meting held at New Plymouth at the Winning of February last ho meisurert a 20-chain atrip of Avenue Road, and on the dayß of the races he had placed two men in the locality, with stop watches, to take the number of all cars travelling over 30 miles per hour. Th» by-laws prohibited drivers travelling mere than 20 miles per hour. The refilt was that eight drivers had been pi executed. Following are the names of the men summoned: Edward Cleaver, Alfred Cronin, W. R. Free, Alex G. Judson, 11. O. Paynter, R. Robinson, S. Selwood and C. E Coldrick.
Inspector Day gave evidence in each case as to measuring the distance on Avenue road.
Leonard Goodwin gave evidence to being engaged by the borough inspector to chock the speed of motor cars on Avenue road on the last race days. He checked the cars and all those summoned had covered the 20 measured chains in ?8 or 2f) seconds.
Each defendant wsa convieited and fin.'d the sum of 10s (costs 10s). " Eobert.jon was also charged with failing to notify the change of ownership of a moior car. He was convicted and orderef to pay the costs, 12s.
