HAWERA.
S.M. COURT, Before W. R. Haselden, S.M. Hawera, March 15.
A sitting of the S.M. Court was held yesterday morning. Four cases of driving motor cars at an excessive speed on February 13 and 14 were heard. The evidence showed that the drivers were'proceeding to and from the Hawera races at speeds ranging from 35 to 40 miles per hour. Fines and costs averaging £5 were inflicted in each case.
A civil Rogers v. Somervail, involved rather aNiice point of law. The defendant had u friend named Chadwick, and the latter requested Somervail, a farmer at New Plymouth, to "shout" him a suit of clothes. Chadwick stated that Somervail replied: "Certainly, my boy. You can go to Rodgers and order "a suit and send the bill to me." Defendant then asked when he wanted the suit, and Chadwick said December, 1910. Somervail told him "not to get it. at oresent, but to wait till January and I'll send you an order." On January 10 he did send an order, but gave it to his son to post, and the order was not received. Chadwick got the clothes, and the bill was sent to Somervail, who did not take much notice of it until August 22, when Somervail wrote to Rodgers', saying that it was true that on January 10 he gave Chadwick an order for clothes, but as he got them before that day, he (defendant) owed Rodgers nothing. Mr. Powell appeared for the defendant, and Mr. F. C. Spratt represented Rodgers. After hearing legal argument his Worship reserved, judgment.
