AN AUSTRALIAN'S APPEAL.
A QUESTION OF RESIDENCE. , At the sitting of the First Wellington Board at Hawera on Monday, Hugh Henry Madden, for whom Mr O'Dea appeared, appealed on the ground that he was not domiciled in New Zealand. Appellant, who is a cheesemaker employed by the Kaupokonui Dairy Com--pany, said that he was working manirger of a cheese company in Australia, but left in July, 11)15, to gain further experience in checsemaking in New Zealand. Mr Cuddie, Dairy Commissioner, recommended him to try either Hawera Dairy Company or the Kaupokonui Dairy Company for experience. He intended to remain only one season, and frequently expressed his intention to return to Australia to his fellow-workers. At the end of the sea son in May, 1916, he applied for a permit to leave New Zealand, but was refused. In November, 1915, in filling up his National Registration card, he stated that he was only temporarily resident in New Zealand. Evidence was given by L, Landers, T. Bryan, J. Lang and J. Landers, W'ho had worked with him in the Kaupokonui factory in the 1915-10 season, that hp frequently expressed his intention of returning to Australia at the end of the season. Mr. O'Dea, the Board, said that two similar cases had been before the Third Wellington Military Board, and the Board had decided that compulsory residence was not residence at all. He submitted that Madden was compulsory resident in New Zealand, and therefore could not be considered a resident of New Zealand. The Board reserved its decision, and subsequently announced that it was of the opinion that the appellant was an Australian, and therefore not a rese'rvist. The appeal would be allowed. —Star.
