QUALITY OF MILK.
ALLEGED ADULTERATION. CASES DISMISSED. At the New Plymouth Magistrate's Court yesterday, Mr. A. Crookc. S.M., delivered reserved judgment, in the cases in which .lack Sanger and Robt. Clemow were charged with having on June 19 unlawfully sold milk containing less than 5.5 per cent, of solids other than butterfat, and, on a second information, that the milk contained added water. Mr. A. TL Johnstone appeared for the defendants.
His Worship said that the defence raised by Mr. Johnstone was that Clemow, who sold or purported to sell the samples of milk lo the health inspector, Mr. Kendall, was not the servant nor the agent of 'Sanger, to whom the milk belonged. There was no question but that Clemow was not a servant, and the only point remaining 'was as to whether lie was an agent or not. The evidence had shown that 'Sanger served his customers first with milk, and had arranged that any surplus should be taken into Butler's dairy by Clemow. Sanger left this surplus' milk by the roadside and Clemow took it into the dairy. It seemed that Clemow acted quite voluntarily, and was simply the person who carried the milk, having no authority to do anything else with it to sell it or deal'with it'in any other way. Under these circumstances it appeared that there was no agency. The informations would be dismissed on the ground that Clemow was not an agent for Sanger.
