MAGISTRATE'S COURT.

THURSDAY, MAY 24. (Before Mr. A. Crooke, -S.M.) BREACH OF PROHIBITION ORDER Hugh Beath McViear, who failed to appear, was fined £2 with costs 7a, for procuring: luquor luring the currency of a. prohibition order against him. BY-LAW CASES. John Pettit was fined 10s with costs 17a for driving a spring cart without a light on a 'Taranaki county road. For riding an unlighted bicycle on Baxrett Road, Taranaki county, VaJ liiggins was fined 5s witli costs £1 13s. Ernest Watson, charged with allowing a. mare and foal to wander at large on a county road, admitted the fact, and his responsibility, and was fined 10s with costs 17s 6d. In each of the above cases Mr. J. H. Quilliiim appeared for the Taranaki County Council. Tlie following fines were imposed for breaches of the New Plymouth Borough i:<y-!aw9j[ on the iaformation of snspector Tippins, there being no appearance of the defendants:—Henry Wade, parrying a passenger on a motor cycle otherwise than in a side-car, ss, costs 7s; lames McNeil, allowing horse to wander at large, 10s, costs 7s; 'IT. G. Winkleman, driving a motor car recklessly in Devon street, 10s, costs 14s. Samuel Loveridge pleaded guilty to a charge of having smoked a cigarette in the Good Templar Hall, he not being a performer on the stage. Defendant admitted the act, but said he did not know he was committing an offence. His Worship said lie would not have kno\vn either that it was an offence. Defendant 'would be convicted and ordered to pay costs 7s. ALLEGED NUISANCE.

George Bruee was charged with having permitted a nuisance on his premises in Countcnay street. He pleaded not guilty, and Mr. A. H. Johnstone appeared on his behalf.

K. Day, Borough Inspector of Nuisances, gave evidence to the effect that on visiting the premises he found it in a fifthj' condition owing to fowls and five dogs being kept. There had been diphtheria cases in the neighborhood, and one of the cases had vjsitcd Brnce's house. Anyone going to Bruce's house would have to go through this filth.. B. Tipp'ms, Borough Inspector, was called to give corroborative evidence, hut stated that in his opinion the place was untidy, but not filthy. His vVcriOiip said that on tho evidence and as there was nothing to show that the condition of the place was a menace to health, the charge would be dismissed.
