Suisted) with' clTectina a sale of a digester without notifying the inspector within the prescribed' lieriod Charles W. R. Suisted, Inspector „f Machinery, said the digestor in question had been in use in a butcher's siiop in New Plymouth, and hud been condemned three years ago is unfit to stand the pressure it would lie necessary to impose on it when in use. It had been owned by A. Allen, and witness bad received verbal notice that it had been sold to Winkelmann. Gilbert and Sons, of Wanganui, bought the machine from Winkelmann, who failed to notify witness until three weeks afterwards'of the sale, instead of forthwith, as required by the Act. Witness quoted an advertisement in, whic-h the defendant had offered the machine, which he described was in first-class order, for sale. 'William Gilberd, of Wanganui, gave evidence concerning the negotiations with defendant in connection' with the sale.

Mr. Fitzherbert, for defendant, pointed out that defendant was not the owner of the machine hut the agent. The sale, lie said, had not been effected, but in order to ho on the safe side defendant had forwarded a notice to the inspector as soon as he learnt that a bank draft had been paid. As a matter ol fact, the digestor had not been sold. Evidence was given by defendant that ho had never owned the digestoi, but had merely acted as agent for Allen The Bench dismissed" tl\e information on tin ground that it was Allen, and not Winkclmar.n, who was the owne.-,

MISCELLANEOUS J. L. Connett was proceeded lgainst for driving ■) n-.otor-car round o corner in Devon Road, Fitzroy, on November ! at an excessive speed. Inspector Tipping said defendant had driven the cai at over Sfteen miles an hour, or more than double the speed permitted under the by-law?. A fine of 10s was imposedA. J. For allowing a cow to wandei at Fitzroy Richard Johnston was <3ned 10s. W. Sturmey, a youth, was fined 2s 6d for riding a bicycle on the footpath. . Finea of 5s in connection with each of two counts of driving a lorry without a. registered number-plate, and in connection with each of two counts of driving without a license, were imposed on Joseph Hockey.
