FORGERY AND UTTERING.
COMMITTED FOR SENTENCE* Before Mr. A. Croke, S.M., yesterday, Albert Thomas Skallie, alias Scully, was charged with having forged the signature of W. Seott to a cheque for £4 5s Gd, drawn by Charles Kyngdon, in favor of Scott, and uttering the cheque to one, Louisa Fanny Boulton. Sub-Inspector Foully prosecuted, and accused was not represented by counsel. Sub-Inspector Fouhy outlined the case. Accused was in the employ of Messrs. Kyngdon and Douc'n, contractors, at Fitzroy, and had been recommended to board at Scott's boarding-house. Mr. Scott agreed to take accused on condition that Mr. Kyngdon guaranteed the board, which he did. On September 2 accused went to Kyngdon, and asked for a cheque to pay his board. Kyngdon made out the cheque mentioned in the information, and made it payable to Scott. Accused went to Mis 3 Boulton's shop, and on it being pointed out that it wanted endorsement accused wrote Scott's name on the back of the cheque and Miss Boulton cashed it. None of the money had been recovered. (
C. C. Kyngdon deposed to engaging accused as a laborer at lis per day, and recommending him to Scott's boardinghouse, also to giving a guarantee for payment of his board. On September 2 accused told witness he was going to Opunake and wanted his money. Gave him a cheque for £4 5s Od. payable to W. Scott, and told accused that Scott would give him the change. Louisa Fanny Boulton, storekeeper, Devon street, said that accused came to her 1 shop on Saturday morning and purchased goods to the value of 21s sd. Tendered the cheque produced in payment. Asked accused to endorse it, which he did, and witness gave him £3 4s Id in change. Accused was quite sober.
William Scott, boarding-lionse IceepeT at Fitzrov, stated that accused owed him £•2 5s for board. Had not previously seen the cheque produced, and the endorsement was not his. Had received a cheque for £1 3s 4d on a former occasion. Saw accused on Saturday forenoon and asked liiin for his board. He. went upstairs, saying he would pay, and when accused came down he paid Mrs. Scott I-2s Cd. Witness did not authorise anyone to sign his name on the hack of the cheque, and the endorsement was a forgery. Accused was much tinder the influence of drink at 11.30 a.m. Bessie Scott, wife of last witness, gave evidence as to arranging to board accused, and on August 19 receiving a cheque for £1 3s 4d, payable to W. Scott or order. Deducted accused's board and gave accused the balance. Had not received any other cheque from liira, and had not before seen the one produced. Constable P. Boulton deposed to arresting accused at the boarding-house on Saturday evening. Accused remarked, 'Well, Scott might have given me a change to get the cheque 'back." Accused stated that thir was the first time he had ever used another man's signature. Had not used it for the purpose of doing Scott a bad turn for his board. Had had several drinks before producing the cheque to Miss Boulton. Signed Scott's name, not thinl-:i" '■ present view would be taken of his action. Had Scott's money put away in an inside pocket, but when asked for his board found lie had only 12s Cd left, which lie gave Mrs. Scott. Had a good record for always paying his debts elsewhere. Accused pleaded guilty to both charges and was committed to the Supreme Court, to commence this morning, for sentence.
