An interesting case was before Mr. Justice Cooper on Friday afternoon at Auckland, its purpose being to determine tbe position of Lieutenant Roy Cargo, who was kiljed at Gallipoli, under the will of bis father, the late James Cargo, of Ponsonby. Mr. Cargo left bis estate, worth about £3500, to his wife for life, or for her period of widowhood, with a provision that if she remarried, or if she died, the residue should go to her five children. Lieutenant Cargo having predeceased his mother, who has not remarried, tbe question has arisen in connection with the stamp duties payable upon his own state, whether he took a vested interest in his father's estate, which was transmittahle to bis legal successors, or whether tbe gift in bis father's will was a .gift to a-class, and therefore, on his death, his interest passed to his mother, brothers, and sisters.' Mr. W. P.' Endean appeared for the executors of the will, and Mr. B. McVeagh for the members of tbe family concerned. After argument, his Honor hold that the bequest in James Cargo's will was not a gift to a class, but that each of his children took a vested interest in tbe reversion of his estate, because all were described by name. Judgment was given accordingly.
