MAGISTRATE'S COURT
UNDEFENDED CASES. A sitting of the Magistrate's Couvt was held yesterday morning, Mr. A. Crooke, S.M., presiding. Judgment was given for plaintiff in default of defendant in the following cases:—MclOwen tiros. (Mr. F. 10. Wil■tion) v. M. Scally, £1 IDs Dd (lis costs); Baker and Co. v. \Y. J. Huston, 12s costs only.
A CLAIM FOR DAMAGES. J. Gilbert (Mr. F. E. Wilson) proceeded against Henry Newland (Mr. A. R. Standieh), claiming £5 general damages and £2 Ss Cd special damages, caused by the negligence of the defendant. The evidence for the plaintiff showed that on November 17 last several vehicles were proceeding along the Frankley road. Miss Okey, in a trap, was leading, and when a vehicle containing four children approached from the opposite direction, Miss Okey drew to the left, and the children drew to their left. There was an opening between these two vehciles, and the defendant, who was following Miss Okey, attempted to drive through the opening, and in doing so collided with the trap containing the children. The plaintiff was driving behind the defendant, and when the collision occurred the plaintiff's horse stopped suddenly, with the result that the plaintiff was thrown out on to the road and was stunned. The effects of the accident kept the plaintiff in bed for a week, and lie did not completely recover for a fortnight after that. The case was partly heard and adjourned till next Tuesday.
