WAITARA BOROUGH COUNCIL. * i IS HEREBY GIVEN that at a special meeting of the Waitara Borough Council held on the 21st day of December, 1915 ;t was resolved (by way of .special order) that the Waitara Borough Council make By-laws under the Public Health Act, 1908, as follows; {! WHEREAS by notice in the Gazette No. 121, of October 21, 1915, page 3567, His Excellency the Governor, x under the provisions of Section 65 of "The Public Health Act, 1908," declared that that portion of the watercourse known as the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Waitara ' Borough Council, and all the tributaries thereof, shall be placed under the control of the Waitara Borcujjh Council. Now, therefore; the Council of the Borough cf Waitara. as such specified controlling local authority, hereby, in exercise of its powers under Section 67 of "The Public Ileilth Ac.';, 1908," and under "The Municipal Corporations Act, 1908," makes the following by-laws that is to say: — 1. The short title of these by-laws is "The Waitara Borough Public . I Health By-laWs, 1916." I 2. "Borough Council" means the Coun- i cil of the Borough of Waitara. "Inspector" means any officer or officers for the time being appointed by the Borough Council for the purposes of these by-laws. 3. Every person commits an offence J who, in any way:— (a) Defiles or pollutes that portion of the watercourse known as the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Borough Council, or of the tributaries thereof (all of which form part of the water supply of the Borough of Waitara). (b) Permits or suffers drainage or refuse from his land or premises |r: to flow into or be deposited in " r that portion of the watercourse ■ known as the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Borough Council, or any of 1 the tributaries thereof (all of which form part of the water supply of the Borough of Waitara). , 4. It shall be iawful for any Inspector * at all reasonable times in the day j , time to enter upon and inspect any land or premises for any purposes connected with these by-laws. Every person commits an offence who, in any way, directly or indirectly, obstructs or hinders any inspector in the making of such inspection or in tKe performance of , any duty .under these by-laws. j 5. If any person commits an offence r against these by-laws, he shall be liable to a fine not exceeding Five pounds ( £5), and, in the case of a continuous offence, to an additional ; fine not. exceeding five pounds ( £6) for every day on which the offende ' is continued after the first ia.yT The said resolution will be submitted for confirmation to the ordinary meeting of the Waitara Borough Council to be held at the Municipal Chambers, Queen Street, Waitara, on Wednesday, the 2nd day of February, 1916," at 7.30 p.m., at which meeting the day of coming into force of the by-laws will be fixed. A copy of the proposed Special Order and By-laws is deposited at the office of the Waitara Borough Council, Queen Street, Waitara, where the same will be open for public inspection during office hours until the" said' confirming meeting is held.
