WAITARA BOROUGH COUNCIL, IS HEREBY GIVEN that at a special meeting of tho Waitara Borough Council held on the 21st day of December, !91"> ;t \ras resolved (by waj of special or.ift':) that the Waitnn Borough Council make By-lawa under the Public Health Act, 1908, as follows: WHEREAS by notice in the Gazette No. 121,' of October 21, 1915, page 3557, His Excellency the Governor, under the provisions of Section 05 of "The Public Health Act, 1908," declared that that portion of the watercourse known an the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Waitara Borough Council, and all the tributaries thereof, shall be placed under the control of the Waitara Bor( ugh Council. Now, therefore, the Council of the Borough o f Waitara a? such specified controlling local authority, hereby, in exercise of its powers under Section 07 of "The Public Heilth Ae.i, 1908," and under "The Municipal Corporations Act, 1908," makes the following by-laws that is to say:— 1. The short title of these by-laws is "The Waitara Borough Public Health By-laws, 1910." 2. "Borough Council" means the Council of the Borough of Waitara. "Inspector" means any officer or officers for the time being appointed by the Borough Council for the purposes of these'by-laws. 3. Every person commits an offence who, in any way:— (a) Defiles or pollutes that portion of the watercourse known as the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Borough Council, or of the' tributaries thereof (all of which form part of the water supply of the Borough of Waitara). (b) Permits or suffers drainage or refuse from his land or premises to flow into or be deposited in that portion of the watercourse known as the Waiongona Stream, from the source thereof to a point half a mile below the intake of the water supply of the Borough Council, or any of the tributaries thereof (all of which form part of the water supply of the Borough of Waitara). 4. It shall be lawful for any Inspector at all reasonable times in the day time to enter upon and inspect any land or promises for any purposes connected with these by-laws. Every person commits an offence who, in any way, directly or indirectly, obstructs or hinders any inspector in the making of such inspection or in the performance of any duty under these by-laws. 5. If any person commits an offence against these by-laws, he shall be ■ liable to a fine not exceeding Five pounds ( £5), and, in the case of a continuous oil'ence, to an additional fine not exceeding five pounds ( £5) for every day on which the offence is continued after the first day. The said resolution will be submitted for confirmation to the ordinary meeting of the Waitara Borough Council to be held at the Municipal Chambers, Queen Street, Waitara, on Wednesday, the 2nd day of February, 1910, at 7.30 p.m., at which meeting the day of coming into force of the by-laws will he fixed. A copy of the proposed Special Order and By-laws is deposited at the office of the Waitara Borough Council, Queen Street, Waitara, where the same will be open for public inspection during office hours until the said confirming meeting is held.
