A LAW CASE SETTLED. By Telegraph.—Press Association. Auckland, Saturday. Tlie case between the Ridd Milking Machine Company, of New Plymouth 1 (plaintiffs), and the Treloar Milking Machine Company, of Hamilton (defendants), in which allegations of ii. fringement of patent were made, and in which an injunction was asked, was settled by the Supreme Court under the following terms:—Firstly, that defendants submit to the injunction as played for, hut the injunction shall not be flefned to apply to the triangular inflation, a description of which has been lodged with the Registrar and signed by counsel, and it is declared that plaintiffs do not and will not object to the manufacture, use, and sale of such inflation; secondly, that defendants are to be allowed to sell their existing stock of inflations and to pay plaintiffs a royalty of Is each thereon, but this shall not apply to inflation expressly excepted from the operation of the first paragraph;, thirdly, that defendants are to pay plaintiffs' costs on a scale to be fixed Dy the court; fourthly, that plaintiffs undertake not to take any proceedings against bona fide farmers who have hitherto purchased any inflation exhibited; fifthly, that plaintiffs waive any claim f,i damages or profits. The Cine Company, of Auckland, applied for an injunction against .f. B. MaeFwan and Co., of Wellington, for alleged infringement of patent to prevent the sale by the defendant company of milk releasers. Defendants admitted the infringement and agreed to discontinue it. Terms of settlement were agreed to, subject to preservation of the right of plaintiff to apply for a certificate of validity under section 37 of the Patents Act, 1911, in order that full coats might be recovered in the event of any further infringement. . The injunction was granted by the court.i with permission for plaintiff to apply for a certificate of validity.
