AN INTERESTING CASE.

Judgment has been delivered in the Supreme Court, Wellington, in the action brought by George \V. Mean, chemist, Wauganui, 'proprietor of I lean's Cough Essence, against Percv (\ Eaton, chemist, ami William J. R.' Hill, commercial traveller, both of Auckland, and trading as Hill's Essence Proprietary. The plaintiff sought to restrain the defendants from passing off a cough mixture which, it was alleged, was named, bottled, labelled and packed to resemble Hciin's Kssenee. and thereby to mislead tlm public.

Defendants did not appear, and Mr. Justice Hosking ordered that an injunction he issued restraining the abovenamed defendants from passing oil 1 or attempting to pass oil' any cough essence not manufactured by George W. Hean. and res-training defendants from offering for sale any cough essence not of plaintiff's manufacture by means of the use oF cartons, labels and hollies similar to those of George W. Hean. His Honor also ordered that the profits made therefrom he computed by the' Registrar of the Court and paid over to the plaintiff; that_ all packages of Hill's Essence offending against the injunction granted be handed over to the plaintiff, and that the defendant also pay to the plaintiff .020 Is as costs and disbursements,
