Very important points were raise?! in the hearing of an industrial case in tlie Magistrate's Court this morning bv Mr. Cohen, counsel for defendant, a barmaid charged with refusing to join the Hotel .Workers' L'nion when requested. Mr. Cohen's main point was that this award practically amounted to vonrnulsory unionism, a condition of affair?; not contemplated 'by tha I-egistalnre. T!:;! award was ma le fro"? the rcsorwev.dations of the Council of Conciliation, which the parties agreed to acee.pt, and was sanctioned by the Arbitration Court without discussion. Barmaids who were not members of any association or union Tvere prevented by law from parti^pat r ;:j at the Conciliation Council in any discussion sonccßiitig the award to which they were made parties. Tiic Magistrate (Mr. Kerr) said lie must hold the award binding until ii had been 'proved otherwise, and gave judgment for plaintiff. A fine of £2 was imposed, an appca! to he made to the Arbitration Court, on the point Vai-sed by Mr. Cohen. The point of appca! affects a number of awards made in a similar manner.
