IN SHIPPING LAW.

A case, said to be the first of the kind in New Zealand, caine before Mr Cooper in the Magistrate's Court to-day. James Cottercl, a fireman on the Tainui, wlio had signed on in London for the round trip to the Dominion ind back, applied, under section 88 of the Shipping and Seamen Act, to have the contract rescinded. Cotterel said he had every intention of completing the voyage, but when he arrived in Wellington lie found his wife ill and deprived of support, his previously arranged wages being insufficient to support her and three children. Captain Moffat complained that the company would be put to additional expense if the application were granted, also a bad precedent would be created. His Worship said he. thought Cotterel should provide someone to fill the vacancy and adjourned the application until to-morrowl.
