ALLEGATIONS OF MALICE,

'Received March 22, 10.30, pjm Sydney, March. WL Baeycrtz submits that the alleged libel was contained in the following paragraph: "That unconscious comedian of culture, C. N. Baeyertz, accuses, Elsie Spam of making 'crs' of all her 'ors' This is very painful and ridiculous. It is strange that Herr Baeyertz, of all people, should lodge the complaint, as he suffers in spelling what he alleges of the English girl in the song." Plaintiff's counsel stated that early in 1014 the plaintiff came to Sydney to arrange for the publication of an edition of the Triad, but the project was suspended owing to the war. The Theatre Magazine attacked plaintiff personally, affording evidence of 'malice. Plaintiff contended that his criticism of Elsie Spain was not objectionable. His ancestry was Belgian, and there was no suggestion of German Wood in his veins. He' objected to he called "Herr Baeyertz," and stated that he had suffered considerably* thereby. The case is part heard.
