AN APPEAL REFUSED. By Cable Press Association!— Copyright. Melbourne,, March 17. The High Court of Australia dismis* sed the appeal in the Bernasconi case. Judge Murray stated a special case oil several grounds, the main point beingwhether Bernasconi was right in' his claim for a trial by jury. The Chief Justice said the section of the constitution providing for trial by jury related only to offences created by Parliament by statutes passed in the'execution of its functions and described as the laws of the Commonwealth. The request for. a jury was therefore rightly refused. Justices Isaacs and Rich concurrcfl. (Bernasconi hung a native boy in his store in Papua and was sentenced by Judge Murray to a year's imprisonment. He appealed for a trial by a jury,)
