Acting on behalf of himself and other preference shareholders in the 'Commercial Bank of Australia, George Mendall sought a declaration for an injunction to restrain the bank from fulfilling its announced intentio,, of paying ordinary shareholders a dividend of 1(1 per cent, without first providing for the restoration of the lost preference capital.
