Mr. D. <i. A. Cooper, S.M., was on tin; Bench. In tlit: course of his statement on oath, defendant said his firm had been in business in Auckland for the past two years and a quarter. The firm exported Xcw Zealand produce to England, Europe, and tile United States. While on the Continent recently he made arrangements with Gustav '\V. .1. When the war broke out these goods, originally intended for Hamburg, were on tin; high seas. Two of the Herman boats carrying cargo for his firm sought shelter in neutral ports, and a third vessel was captured on the high seas, in ignorance that the war had commenced. The prisoner complained that lie had been unable to prepare his defence property, localise tile military authorities would not release him on parole from Somes Isla'url. The Magistrate said he could not help him on that point. Mr. Ostler produced further correspondence (received to-day through the censor) between Witt and Duerkop, relating to cargoes, and what was to be done about them owing to vessels being interned in neutral ports. The case was further adjourned till Wednesday.
