COMPENSATION CLAIM.
A [PECULIAR CASE. By Telegraph.—'Per Press Association. Wellington, Last Nsrht. "Can a right to compensation survive the death of a worker w<lien he leaves no dependents?" This was the point involved in an action hoard by 'Mr. Ju»--tice Stringer at tho last sitting of the Arbitration Court in Wellington, judfimien in which has now been received by tho Clerk of Awards. The case was that of Hanry Hodge, as administrator of the estate of hia lato son, Fred Hairy Hodge, formcrki of Alton, Taranaki, against the Alton 00-operativo Dairy Factory Oompany, IM. Ori January 22, 1914, the deceased met with an accident arising out of his cm • jloymcnt by the defendant company, and" in con&equence lost the lower part of his right arm. While in the Patea Hospital he contracted typhoid fever, as b, result of which ho died on (March 24, 1914. Tho defendant oompanv paid the amount payable in rcspiiet of tho total ircapaeity of the dcc«aai.xl up to the time of his death.
The plaintiff claimed that the deceased was at tho thrift of bis death ontttled under the Workers' Compensation Act to payment by tho defendant sompaniyi of compensation for the loss of his arm in accordance with the second schedule to the Act, and that such right was a Tested right, vind therefore had been transmitted to him ae the administrator of flio estate o£ the deceased. His Honor ruled that the right to <h« weeklv recurring paynicntsi having ceased owing to tho death of the dcoeased, and there having been no comv mutation of such pay-moots, and there now being no one capable of miakins amplication for such commutation, it followed that the plaintiff was not entitled to Teoovor in this action.
