Mr Kiddell, S.M., gave judgment in an interesting civil action in which the defence placed reliance on the Moratonum Act passed last month. The claim waa for instalments of principal and interest due under the mortgage of a, lease by defendants to plaintiffs. Plaintiffs admitted that tliey had not applied to the Supreme Court for leave to take action as provided in the Mortgages Extension Act, consequently the defence contended tliev could not succeed. His Worahlip .pointed out that the action was commenced in April last. Thorn was no provision in the Act making it retrospective. Judgment was according!) for plaintiffs.
