A CURIOUS POSITION.
ALLEGED ILLEGAL WARRANT. By Telegraph.—Press Association. Wellington, Yesterday. LAn unusual position furosc ini' the 'Magistrate's Court to-day. A young man named Joseph. Dowling, su'wlcd on a warrant at- Auckland and charged with failing to provide, for the maintenance of his mother, appeared in custody. His counsel protested that .his (•Kent was not legally before the court. There was no power under the statute to arrest, him. He should have been ue-.ilt with by summons and shotiM lis served with a Rinnmonn now and allowed to walk into court. I inspector Hendry: Yes, aid''take the first boat to and leave his mother to die in the gutter. 'Magistrate Cooper: The. man is here and we will hold him. The warrant was issued by another magistrate. Von cannot expect inc. to traverse his action. The ease was adjourned till to-mor-row to en-ible the mother to obtain legal assistance.
