At a special meeting of the Xew Ply mouth Borough Council last night, held, to consider further developments with regard to the proposed public convenience in Brougham Street, there wer» preaut: His Worship the Mayor (Mr W. Browne) and C'rs. J. Kibbv.lV 11. Jackson, W. Healy, J. Clarke, N. T. Maunder, A. E. Sykes, A. H. Johnstone, \V. A. Collis, W. Anibury, G. Tabor, J. E. Wilson, and J. T, Mannix.
The recoiistitiiUon of the Council by tho election of Mr Sykes in place of Cr. A. Clark, lias altered the view of the Council as a whole on thin matter, as the following report shows. A ( 'OMPI{( ).M IS 10 OFFERED.
Messrs. Roy and Nicholson, solicitor*, for the lirougham Street objectors, wrote enclosing a letter from Mr R, C. Hughes to the Council, as follow*: - "With reference to the application which has been forwarded to 'the Supreme Court, for an injunction to restrain the Council from proceeding with the proposed public convenience, on behalf of myself and my co-plaintiffs, [ offer to stay proceedings and pay £>o towards the costs incurred by your Council, on condition that a satisfactory ussurance is given to the plaintiff* that the Brougham Street site will be definitely and finally abandoned, and that the Council will not select any other site in that part of Brougham Street, lying between Devon and Vivian Streets* It is, of course, to be understood that the, acceptance of this offer will bind only tlie present Council during its term of office, viz., until the end of April, 1013." The Town Clerk had written, by the. instruction of the Mayor, asking (for the information of the Council" when considering this letter) whether Mr. Hughes would adhere to his offer if the Council were to add a condition that no site for the conveniences should be selected before the ci«l of April, 11)15. Mr Hughes wrote in answer, stating [ that he would have no objection to Mich j a condition.
After the matter lmd been discussed in committee. Or. Clarke moved, and C'r. Jackson seconded, that in the event of tlic Judge of the Supreme Court sitting next week refu&ing to grant an injunction against the erection of the convenience, the Mayor Lc authorised to instruct the Engineer to takfl immediate steps to have the convenience erected, without further consideration by tlia Council.
This motion was lost hv seven votes to six, the division bcin;>: Ayes—Crs. Kibhy, Jackson, Ifealy, Maunder, anil the Mayor; noes—Civ. Sykes. Johnstone. Collis, Ambiirv, Tabor, Wilson and Mannix.
Cr.'Clarke then moved, (hat in view of the fact that a majority of thoCounci! is a<»ainst the Brougham Street site, the offer of Mr R. 0. Hushes be accepted. and the Council give nn' undertaking to the plaintiffs that no site for the convenience shall he selected bv the Council before the end of April, 1(115. This Wftß carried.
