Mr. Justice Cliapman delivered' his reserved judgment in the Supreme Court in the originating summons in which a question Lid been submitted to the court in connection with the will of the late Daniel McGregor. The Public Trustee was plaintiff and Mark Johnston, of New Plymouth, and Alex. G Brett, of Parnell, defendants. His Honor held (a) that the capital was to be held till the death of Duncan Henry MaGi'egor for the benefit of any children he' might possibly have if lie married in future ;(b) that the income was to be accumulated as accessory to the capital funds for the benefit of such persons as ultimately came within the description i ot the class and show themselves thus entitled to such accumulations. Tii<> trust could run onlv for 21 years from the forfeiture of income, that bein-r the period allowed by the Thellusson°Act, 1800. The costs of both parties were allowed out of the estate. Mr. Macdonald (solicitor to the Public Trust Office) appeared for plaintiff and Mr. Alexander Dunn for defendants. WELLINGTON DIVORCE CASES. Wellington, Monday."
