Tweedale with having failed to take out a certificate for a 50 li.p. suction gas engine used by them at (lie ironsand works at .Moturoa. The inspector said that defendants had not complied with the provisions of the Aet ill making use of the machinery without a certificate. The department had no wish to press the charge, hut asked for a nominal penalty. The Parapara Company, of (liristchnreh. had, he .said, leased the machinery to a local syndicate. who were. howcv j r. responsible, they not heing in the position of employees of the company. Ihe defendants, said the inspector, were under the impression that they had no liability in (lie matter. Smith said that they had worked _ the plant for one month, and had no idea that they were obliged to take out a certificate, but were willing to do so. The Magistrate said that he would adjourn the case till ne\t sitting, when, if the defendants had taken out a certificate. lie would merely convict and discharge them.
