In tlie Probate Court llaydou Erskiue Starke claimed the revocation of a codicil of the will of Miss Maria Matfingley, of Kensington, bequeathing £7500 to Dr. Frederick Bryan, an Australian, who was Miss Mattingley's grand-nephew, and also £7500 to Mrs. Starke, who was a passenger on the] Waratah. Plaiiitill' alleges that Bryan unduly influenced the weak-minded testatrix, whose relations are chiefly hi Australia, She died the day the Waratah was supposed to have foundered. The codicil also left the residue of £IO,OOO equally between Dr. Bryan and Mrs. Starke on condition that if either predeceased the testatrix the whole of the residue was to go to the survivor.
