ISLAND FRUIT.
ALLEGED NEGLECT BY THE UNION COMPANY.

The Chief -Justice and a jury of twelve are hearing to-day a case in which Carl Kphn, of Auckland and Ravo.tonga, and other Rarotongan planters and merchants, are slicing the Union Steam Ship Company to recover £1022 as damages for the alleged failure of the company to load a large quantity of Island fruit by the Maitai, bound for New Zealand, on February 22 last, in consequence of which the fruit was damaged. As an alternative cause of action, plaintiffs allege that the company contracted to cany the fruit by tho Maitai, and issued shipping notices. Because of her unseaworthy state, the steamer was unable to keep to the time-table, and was thereupon unable to fulfil the terms of the contract. The fruit was delivered to the company under warrant that it would bo, taken, and for this alleged breach of warranty, plaintiffs claim £1022. The defence is a general denial of the allegations. The hearing is likely to . last some time.
