THE ORDER FOR DISCOVERY. By Telegraph.—Press Aesociation. Wellington, Friday. An application was made before Mr. Justice Sim to-day for a stay of execution of a writ of discovery in the case of the Crown v. Merchants' Association under the Commercial Trusts Act.' Tha association claimed the right to seal up parts of the minute book dealing with matters other than sugar, but the Chief Justice had ruled that the whole must be produced. In favor of the present application for stay of execution it wag emphasised that the court had always maintained the sacredness of private rights. Defendants had a right of appeal, therefore a right to stay of execution. The possibility of the order ;for discovery leading to further prosecutions (he did not say that it wonld) wa| a grave reason why the association ahqjilct have the right of appeal. \ The Solicitor-General said there might be a stay of proceedings, but it wqjuld paralyse the force of justice. ) • Argument is proceeding.
