APPEAL COURT.
CUSTODY OF A CHILD. By Telegraph—Press Association. • Wellington, Friday. The Appeal Court is considering the case of Rex v. Mickleson. Defendant Jiad made an application to the Supreme Court for a writ of habeas corpus directed to his divorced wife, with the object of detaining from her the custody • and possession of their child. Mr. Justice Edwards refused the application. On February 22, defendant, it is alleged, unlawfully took away the child from the mother. .. The question for the court's decision was whether the conviction at the June sittings in Auckland on the dhiecition of Mr v Justice Sim was right in law. The Solicitor-General appeared for the Crown and Mr. Singer, K.C., for the prisoner. The case is proceeding. Wellington. Last Night. At the conclusion, of Mr. Singer's argument in the case Rex v. Mickelson, the court intimated that it did not \vi?h to hear the Solicitor-General on behalf of the Crown. The court unanimously decided that thernidge's ruling was right in law and affirmed the conviction. The court then heard the case of Rex v. Westqn. -„ The question raised was the existence or extent of corroboration of the evidence of the two main witnesses for the Crown. Prisoner was convicted for performing an illegal operation on one of the said witnesses at the request of the other main witness. Mr. W. IT. D. Bell nnneared for the prisoner, and the Solicitor-General for the Crown. The court unanimously affirmed the conviction. The court then adjourned till Monday.
