AN INSURANCE CASE

A FINAL DECISION. By Cable—Press Association-—Copyright. Melbourne, May 28. The High Court, by a majority, dismissed the appeal of the Australian Widows' Fund: against the decision in an action brought by the National Mutual Life Company to recover £SOOO. The National Company insured a man named Moran, and re-insured in the Widows' Company. When Moran died the National Company settled the claim and' the Widows' Company refused to pay the reinsurance, on the ground that the statements in deceased's proposal were untrue.

At the first trial the jury found that some of Moran's statements were contrary to fact, and judgment was entered for the Widows' Company. Then the National Company appealed to the Full Court, which reversed the finding. The Widows' Company carried the appeal to the High Court.
