INCITING A STRIKE.

MERCHANT SERVICE GUILD FINED £IOO. By Telegraph—Press Asssciation. Wellington, Wednesday. The Merchant Service Guild has been fined £IOO for inciting a strike. A decision was giv,en to this effect to-day by Dr. McArthur, S.M. The allegation was that during the months of September and October the defendant union instigated certain officers employed by various companies to become. parties to an unlawful strike. It was contended by counsel for the guild that there had not been a strike, inasmuch as it had not been proved that the officers had left work with the intent to compel shipowners to comply with their demands. The reply to this, said the Magistrate, appeared to be that the union made certain demands on 'the owners, which were not conceded. In his opinion the discontinuance of employment was due to a common understanding or agreement, if not expressed )X at least implied, made or entered into by the officers. By their action he thought they thus brought themselves within section 2, subsection 1 of the Act, which defines a strike. It is understood that an appeal will : >e made against the decision.
