Mr. Justice Kenny at Dublin held that the Ussher marriage was invalid in liia eyes of the Roman Catholic ("'liureh, yet was capable of being validated, but it was already absolutely valid according' to the marriage laws of Ireland. The petition was for nullity of marriage on the grounds that Ussher, the petitioner, being a member of the Roman Catholic Church, in a bedroom in his house at 10 p.m., went through a ceremony purporting to be the ceremony of marriage with Mary Caulfield, employed as housemaid in petitioner's house. The petitioner further stated that the marriage was null and void as only one witness was present and the ceremony was not carried out according to the rites, ceremonies and regulations of the Roman Catholic Church. The petition was dismissed with costs.
