ARBITRATION COURT
A VARIED LIST. By Telegraph—Press Association. Wellington, Last Night. The Arbitration Court concluded its last sitting for the year to-day. Justice Sim presided, and with were Messrs. R. Scott and J. A. McCullough, employers' and workers' representatives respectively. In the case in which the Inspector of Awards sought to recover from the Wellington Gas Co. a penalty for an alleged breach of the carpenters' award by employing a carpenter at Miramar, outside the two-mile radius from the city, without paying for time occupied in travelling to and fro, the court held that the company was not carrying on a building business within the meaning of the award. The company was engaged in the manufacture and sale of gas at Miramar, and any building work it did was incidental to its main business. Judgment was given for the defendant company. Mr. McCullough did not concur in the judgment, he considering that the company carried on business in Wellington. Tho inspector proceeded against the Miramar Borough Council for employing an employee to erect picket fences, the man not being a member of the Carpenters' Union, and not receiving the award rate of wages. Judgment was reserved. Edward Charman claimed £7 lis 6d compensation for accident and medical expenses from Charles Emery, his employer. Plaintiff was doing plastering work, and in the course of his employment stooped down and struck a projecting beam, which caused an injury, leading to an abces-s, which had necessitated two operations. The defence was that no notice of the accident had been given. The court held that that was no answer and gave judgment for £7 4s and costs. An item for medical certificate was disallowed.
