HEAVY DAMAGES AWA?tOED. By Cable—Press Association—Copyright. London. October 10. The Court of Session, Edinburgh, in the case Municipal Council of Johannesburg v. D. V. Stewart and Co. and William Beardniore and another, decreed that Heardmore and Stewart were jointly liable for ,-£] 13.134 and Stewart individually liable for £22r>,043 damages.
The action referred to was opened on •Turn' 4 last. Tlie .Johannesburg Municipal Council claimed £o(J':i.(lO() on account of an alleged breach of contract in connection with the supply of pas-pro-ducer plant and oilier machinery for an installation of electricity for lighting and power purposes in Johannesburg. The defendants were D. F. Stewart and Co.. U. 1., of the London Road Ironworks, i:iav;'ow. William Beardinore. shipbuilder and steel manufacturer, of Glasgow, and another. Plaintiffs alleged that the plant did not conform to the contract, and that they were, therefore, entitled to reject it. William and Joseph Beardinore were sureties for Stewart and Co. in €11").(IIH( in connection with the contract. The defendants denied that there was any breach of contract, and alleged that the installation was made according to the plain tills' specifications, and that the pn's'i'ibcd test.s of the machinery were not. reached on account of the unsuitabilily of the. coal supplied liy the plaint ill's for gas-producing purposes.
