SALE OF CHEESE PARCEL
. COURT PROCEEDINGS. By Telegraph—Presa Association. Dunedin, Lust Night. A case arising through an agent deferring the sending of a cahlc awl stopping the sale of his principal's cheese occupied the attention of the Magistrate's Court. PlaintilV was Jonas Dmnbletoii, Otamita, dairy factory proprietor, and defendant B. McEwan, Dunedin, exporter. Defendant acted as agent for plaintiff in consigning ohcc-sp. One hundred ami ninety-nine hundredweight of cheese was delivered for consignment to ami sale in London, per Arawa. on January 17. Plaintiff instructed defendant to stop the sale of the shipment hy cable. Defendmt. according to the statement of claim, did not carry out this instruction, and tb« cheese was sold at o7s fid per cwt.. whereas, if his instructions had been carried out, it would have realised (Is per cwt. Plaintiff claimed the difference on lOf) ewt., amounting to .-C34 10s fid. - The defence was that MoEwan had advanced 3d per Hi. on the shipment, and thus hnd control over it, so that it was not necessary to consult plaintiff. Decision was reserved.'
