SEPARATION AND MAINTENANCE. The adjourned case Amy Mildred Wilkes v. Walter Wilkes, solicitor, Waitara, in which defendant was charged with intent to fail to provide adequate maintenance of his wife and child, came up before Mr. Fitzherbert, S.M., at the local court yesterday morning. Mr. Johnstone appeared for the complainant and Mr. Quilliam for the defendant.

Mr. Quilliam, in addressing His Wor- J ship, recalled the facts of the case. Hel said it had been adjourned from last,) week after several previous adjournments, so as to allow evidence being called from the South Island. The business on which defendant went south was urgent and of a private character, and such as could not in honor be disclosed. The unfortunate combination of circumstances, coupled with his unexplained absence, had no doubt made the complainant feel justified in the action taken, but it was quite unjustifiable. It was not now proposed to have the witnesses present. Defendant was willing to consent to the order being mnde to contribute the sum of 30s per week for the maintenance of his wife and child; he was also agreeable to a separation order being taken out. and that the custody of the child be given to the mother with reasonable arrangements for access; and furthermore that defendant would pay costs.

Sergeant Tladdrell stated the police costs in connection with the ease were £2 15s lid.

Mr. Johnstone said complainant wan willing to accept the terms as mentioned hv Mr. Ouillinm.

His Worship therefore made the order for separation, defendant to pnv 80s a week from that dav in four-weekly payments for the maintenance of thp complainnnt and his child, with costs £4 18s lid.
