A CREAMERY tUAKAXTEE. By Telegraph.—Press Association. Woodville, Yesterday. Judgment was given to-dpy in "the dairying ease, Ilawke's Bay Dairy Co. v. Rosenfeldt, a 'case that has caused a good deal of interest throughout the North Island. The company built a creamery 011 the petition- of certain suppliers, who undertook to continue supplying the creamery with their milk or purchase the creamery. Rosenfeldt was not one of the original petitioners, but he purchased -a farm belonging to one of thrill,. and undertook and signed for the responsibility. In Court' the facte were admitted, but defendant's counsel had claimed a non-suit on the ground that the agreement was not assignable, and, if assignable, was voided by reason of the release of one signatory, and also by reason.of the remoteness of the purchasing clause bringing it withift the rule against perpetuities. The Court held that the first two grounds were not maintainable, but thought the third had not been sufficiently answered. The Court would haye to non-suit plaintiffs, but did so with great regret. It was very sorry it couM not decide on equity and good conscience, but had to decide on law points. Notice of appeal was given.
